1. About these terms
These terms apply when you use the MyBioMark website, join the early-access waitlist or use the MyBioMark app (together: "the service"). By using the service you agree to these terms. If you do not agree, please do not use the service.
2. The service
MyBioMark is a personal biomarker platform: it collects realtime body data through a wearable or connected sensor and translates it into insights on energy, recovery, sleep, stress, performance and longevity. The service is currently offered as an early-access beta: features may change, be added or be removed while we build.
3. MyBioMark is not medical advice
MyBioMark is a wellness and lifestyle product. It is not a medical device and its insights are not medical advice, diagnosis or treatment. Never ignore professional medical advice or delay seeking it because of something you read in MyBioMark. If you have health concerns, talk to your doctor.
4. Your account
You must be at least 16 years old to use the app. Keep your login credentials confidential: you are responsible for activity on your account. Provide accurate information and keep it up to date.
5. Acceptable use
You agree not to misuse the service โ including attempting to gain unauthorised access, disrupting the platform, reverse-engineering it except where the law permits, scraping data, or using the service for unlawful purposes.
6. Your data
How we handle your personal and health data is described in our Privacy Policy. Your measurements remain yours: you can export and delete your data as described there.
7. Intellectual property
The service, including its software, design, brand and content, is owned by MyBioMark or its licensors. You get a personal, non-exclusive, non-transferable licence to use the app for your own private use. You retain all rights to your own data.
8. Availability & changes
We aim for a reliable service but, especially during the beta, we cannot promise uninterrupted or error-free operation. We may modify, suspend or discontinue (parts of) the service; where reasonably possible we will give advance notice.
9. Liability
To the extent permitted by law, MyBioMark is not liable for indirect damages such as lost data, lost profits or consequential losses arising from the use of the service. Nothing in these terms limits liability that cannot be limited by law, such as liability for intent or gross negligence.
10. Governing law
These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.
